Pacific ADR Mediators are available to resolve disputes remotely. We offer a number of videoconference options for mediations amid the COVID-19 Pandemic. Safety is our number one priority when resolving disputes, and all of our mediations and arbitrations will be taking place via Video or Tele-conference technology for the foreseeable future.  Please contact us for more information about virtual options for your next dispute. Pre-Mediation Phone / Video Calls

Pacific ADR mediators always schedule pre-mediation calls with Counsel and Clients in order to discuss:

  • crafting a mediation process tailored to the dispute

  • when the mediation should take place and who should participate

  • whether opening statements will be allowed and how information will be exchanged

  • topics the mediator should be made aware of that may/may not be included in the written statements

 

During the Mediation Session

Using their exceptional interpersonal and people skills, Pacific ADR mediators listen to all parties' perspectives, and thn quickly evaluate party dynamics to establish rapport which allows them to focus on:

  • the issues in the dispute and what may motivate each party to settle

  • making observations to behavior dynamics and when appropriate, assisting both sides in assessing risk, overcoming impasse

  • pursuing creative, collaborative solutions which are consistent with the facts of the dispute

  • attempt to preserve mutual interests of the parties and salvage ongoing relationships

  • ensuring that all parties feel they have been heard and that all reasonable prospects for settlement have been considered

  • guiding parties towards a mutually agreeable resolution

 

Post-Mediation Follow Up

In the event that the conflict is not resolved during the mediation session, Pacific ADR mediators are tenacious in their  follow up. They make every effort to keep parties engaged in the post-mediation process and stay focused on achieving a resolution. Our Mediators will persist until the case settles or every conceivable option to achieve settlement has been exhausted.
